    I agree farming is fun! I did farming when I was young back in INDIA!

    Recently I toured entire US except a few states by road. I saw people doing farming in huge lands like other professions. I saw one community from india owning lots of motels/hotels! To my surprise 20/25 motels we stayed were owned by people of indian origin and most were immigrants.
    To all who claim to be stuck in GC queue I strongly suggest a US road trip. It will show you parts of USA which you have not seen as well as relax ur mind.

    Agree... and this will also increase your awarness. It's a beautifull country and you will enjoy the diversity and resourcefulness. Go mid-west!

    Err... that was about "no work day"... Our agenda is to support one of IVs agendas.. attract media attention. So even if IV does not endorse the method... we are still supporting what IV is attempting to do!

    that's right the actual law had two words that could change the actual meaning of how they are supposed to do it (ie., vertical versus horizontal). Some people (i was one of them) thought that at such a stalemate in the words that coomon sense should prevail. Common sense would dictate that skill would prevail over diversity.

    However; the rules were always such that there was never any horizontal spillover but rather vertical. The main thing that changed was that the unused visas from row could be used by retrogressed countries quarterly rather then annually.
    That is why USCIS never published the regulations for AC21...They are sure as hell that their ass is gonna get sued...whatever regulations they propose... Now it is a miracle that no one has sued them....May be they are waiting for someone to sue them....

    Let me add my observations here:
    For people who doubt where all the money is going, remember Aman founded this organization putting his own money into this ( not in hundreds but thousands). He and some other core members has already got their green cards, but they continue to work for this cause. I also remember Aman and core members saying this "It is not about you. It is about the community. You just don't think about yourself, you work for everyone." Most of the talk points for meetings were meant for relief to the entire community, not a specific group.

    For me, I had to go for a meeting alone. Initially I was disappointed, but I could handle that meeting very well, thanks to IVs training session. For those who are apprehensive about attending these meetings -- It is pretty straightforward if we follow IVs talking points and presentation style. We cover ourselves well with arguments and counter arguments during training session.

    As for meeting lawmakers, it will always be a pleasant experience. This is the greatest democracy on the face of the earth. Lawmakers will lend a patient, listening ears to your issues. No worries there. Also fixes to our issues will benefit not only us, it will help this country in the long run. If you haven't met your lawmaker yet, please plan meeting them and let them know your pains. A meeting from a constituent is very valuable for these lawmakers.

    A request to IV core:
    It is better if IV could conduct the training in different state chapters, so that people will feel more confident and less apprehensive in meeting their lawmakers.

    Labor substitution may be legal but it is unethical. When everything depends on when you join the queue, how can one cut the line?

    Whereas EB3 to EB2 porting is both legal and ethical. When you have a EB3 applicant that is waiting in line for 8 years, he/she had already gathered that much experience based on his long wait. Also, if you look at EB2, it is one of the highly abused category. The EB3 applicant who started in 2001 has joined the line half a decade before the one with 2006 Eb2 PD. One can't really accuse him/her for cutting the line just like one can about substitutes! If the EB3 porting case deserves merit, then I strongly support it!

    My intention is not to to start a fight. But we need to see the true picture. Without acknowledging the problem how can we fix it?
    Bottom line, GC abuses need to stop and we should fight for it as much as we fight for our rights to get GC!

    My wife's case may or may not be fine. She came on H4 and got her H1 in 2004 but got a project only in the middle of 2005 and the company started paying her only once she was on project. But thats fine. If her 485 gets rejected (although the company not paying her is not really her fault), we'll just pack our bags :) Also, her I-140 is still pending.
    I appreciate your taking time for my question.

    Since you're a beneficiary of you're wife's AOS, you're in "pending status of authorized stay". Therefore you *are* authorized to stay here as of that day until a decision on the 485 is made (the unlawful stay clock stops ticking). If you get rejected on your H1 extension, you can still stay in the country and possibly work on the EAD (a derivative benefit of the 485). If you think your wife's 485 is airtight, and there's a problem later you can use the 245(k) provision since you were in unlawful stay for less than 180 days.

    I am not seeing similar outrage as we saw last year.
    The time to act is now.

    Because many of us the green cards ..so the fire got extinguished. I am ready to write letter to Zoe. Can the following be the rough draft ? Also, does anybody have the address where it can be sent ?

    Dear Zoe Lofgren,

    Once again we wanted your help in getting the broken and unorganized process of green card streamlined. In July, 2008 USCIS announced that the people with priority dates upto June 2006 are eligible to have their I485 applications processed. When the time actually came to process them.

    1. Instead of processing them according to the priority dates, they started processing them randomly (although the claim is that they process them according to received dates which is neither true not justified even if it was true) causing people who have been waiting for years(Many of them since 2003 or 2003) to not get their green card and the people who had their priority dates as late as 2006 were issued the green cards.

    2. In the middle of August, they unofficially put the processing on hold (no official announcement to prevent the situation/lawsuit as the last year).

    3. The customer service is totally inconsistent in giving individual answers. We get different answers at different times and most of them are either incomplete or unsatisfying. They also direct us to write letter to the service center directly which results in the response asking us to check website or call 1.800 number none of which again inform the real status of the case. In other words, it is a never ending loop.

    Please help us in resolving the problem as you did last year.

    I am confused now!:D

    I thought that with the Sept 2009 bulletin ( PD shifted to 01 Jan 2005 for EB2 India), my PD is current!


    Am I missing something?

    Your PD is not yet current.
    If they have issued GC to you, it was a mistake and you should report it to USCIS to avoid future problems.

    There were several discussions on this forum about this issue.
    Report to USCIS ASAP that you have been approved by mistake.

    I thought with PD of 2004 by now you should be well aware of how Visa bulletins work. :confused:
    Either you went into hibernation after filing for your GC back in 2004 or you are just faking your profile.

    Five years ago, Yiyun Li had a problem: How do you persuade the literary world to take you seriously when you're a 28-year-old native Chinese speaker trying to write in English, you've published exactly nothing and your training consists of a single adult-education class?

    Since then, the Beijing-born Li's career arc has been so steep it gives her peers vertigo.

    She's had stories published in prestige magazines such as the New Yorker and the Paris Review. She's won the Pushcart Prize and the Plimpton Prize for New Writers. Random House has signed her to a $200,000, two-book contract, which Executive Editor Kate Medina calls -- in what qualifies as a serious understatement -- "most unusual" for a literary writer at this stage of her career. Her first book, a story collection called "A Thousand Years of Good Prayers," was published this fall to wide praise.

    Now she has another problem: How do you explain to the federal immigration bureaucracy what the word "extraordinary" means?

    n the summer of 2004, Li petitioned the U.S. Citizenship and Immigration Services to become a permanent resident of the United States. To approve her application for a green card, USCIS would need to agree that she was an artist of "extraordinary ability," defined in Title 8, Code of Federal Regulations, Part 204.5(h)(2) as "a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor."

    To the upper echelons of literary publishing, Li looks like a slam-dunk to meet this definition. Not to the USCIS, however. A year after she filed it, her petition was rejected.

    She has appealed. A USCIS spokesman says she is likely to get her answer in a few weeks.

    Most people think law suit is a bad thing, but that is not right. In a democratic country law suit is the right way to deal with things. We are legal immigrants, we have all the rights to file a law suit, but with full support of IV.

    People have already filed a law suit on the same day the President signed the bill! (yesterday, the wire tapping bill...)

    By filing a law suit, all we are trying to do is to fix the laws which are not working. Basically, we are doing the right thing. Not only us, but future Legal immigrants will be benefitted, they don't have to go thru what we had to...

    Here are the things that needs to be fixed...

    1. Country quota
    2. Recapturing visas..
    3. 3 year EAD/AP
    4. End the endless wait ( Proposing a new law ;))

    What is "End the endless wait" ?

    EAD is a very good example, If 90 days have passed after filing EAD, you have the option to go to a local USCIS office and get a temp one. We should have a similar option for all the peper work. For example, each and every stage in green card process should have a a day count for processing. Like name check should be completed in 180 days.

    Basically, when we receive any receipt notice, it should have a statement which reads "We have received your application and we will take action within 180 days. If we fail to act by MM-DD-YYYY, Please go to the nearest USCIS for approval.."

    Sounds little ambitious ?? well, we are not asking for too much, just a day count. Lets say if the whole Green card process takes 3 years or 10 years based on the day count for each stage, people can decide whether they want to immigrate to USA with a clear idea that it will take x days to become a permanent resident ( like how it works in all other countries except USA)

    Even a person jailed gets to know how long he is going to spend his time behind bars, but we do not know when we will be free from this immigration mess!

    Guys,

    I want your input on a very important issue. So far I haven't heard anything proper from IV Core. We achieved the pledge goal. This really shows everybody's passion to get the real data.

    We have couple of options:

    1. We deposit all the amount to IV's regular account. In that case quite a few guys have asked for guarantee that first $5000 out of this money will be spent specifically for this purpose.

    2. We create a new paypal account, get all the donation in that acccount and one of us get the data from USCIS and share with everyone on IV thread itself.

    Please let me know your opinion ASAP. This is very important and quick reply is necessary.

    Do you think the visa numbers are over and that is the reason why they cannot allot visa number to you?

    My file is also in local office for the past 4 years and waiting for approval and not able to get any information at all. They keep saying extended back ground check that check and they lose files and it keeps on going with endless wait.
