    Hi,
    this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.

I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.

I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.

So don't judge others just because you have been lucky enough to maintain your status...

Good luck to you all in your I-485s

VZLAN, Ah! I can't return to my country since I am Venezuelan, and I don't plan to raise my kids under communism.

VZLAN I assume you were laid off this year, then you are still within your 180 days. Have you looked at other options eg your wife going onto an F1 with you as a dependent. There are great lawyers out there. If you need some names let me know

Now, instead of getting her into trouble you have to get yourself out of trouble first.

Find a cool way to send her out.

You will be in trouble anytime in future if she proves that you have employed her illegally in the past.

Going a bit tough here, sorry for that.

    1. You both are in H1B (assuming you must know laws behind H1B)
    2. Able to find someone inexpensive who can take care of your valuable baby
    3. Powerful knowledge in technology to setup a secret camera to capture what she does the whole day
    4. Collect all evidences and planning to penalize her

But you are not aware of the simple fact that it is illegal to hire and pay someone without notifying appropriate government agencies.

Anytime in future, if she is caught(chances are more as she is clearly not aware of the laws here and how serious is beating a child, if not in your place some other place), expect query from INS/IRS. This is a different country.

This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

    God BLESS all those current...Amen!!!

Someone gave a RED and left these comments...

"yeah right..and they should come flip pancakes for u...anything else u want them to do inaddition to ur stupid and unreasonable demands?"

Grow up ...and I doubt if you can call yourself 'highly skilled' if you can't reason out. God bless you

Whether i am a minority and whether i am a majority does not make any difference.

If you want legal speak then ...
Giving GC to STEM graduates is not the right way. If US needs to keep these educated people in US then US needs to make sure these educated people get an H1B without any issues and then they are on the path to GC like everyone else because H1B is a dual intenet visa. Jumping from a F1 visa to a GC visa is not correct as F1 visa is not a immigration intenet visa

If you want plain speak then ...
Why should STEM graduates have it easy when a H1B has to struggle and wait in liner to get a GC.

I would agree to this only is the requirement is made so that only PHD and scientist who have atleats acouple of research papers published be given GC and not every Tom, Dick and harry who completes 4 years engg degree in india from a 2 bit university and whose parents have money and uses this money to pay for 2 years MS.

People who are going to benefit by this will support this. Others oppose.
I believe you belong to latter.

One thing to remember is this provision helps STEM grads irrespective of their EB-class.

legal speak: right now law does exist. F1 to GC would be illegal. This provision is to make the conversion legal

plain speak: look beyond your own situation. Since you are not going to benefit directly, does not mean you stand against it.

Lastly, everybody's parents don't have so much money like you think. People do get 13% student loans in India to fund their studies.

Stop eating junk food. It's bad for your health. Save the money that you'd spend on burgers, soda pops, french fries, pizzas and other fattening fast food. You'll be surprised by how much you have saved in a month (and lost weight too).

Donate the money saved to IV. It's good for your health and also good for your GC aspirations.

You said that you are from the Midwest, but your profile says that you send your application to Texas. How is that possible, All midwest I-485 applications must have gone to Nebraska Service Center.

"I am in Midwest and not all the USCIS/ASC offices treat as bad, as these guys may not have that many applicants coming to the office, like int Northeast or California."

I sent it to Nebraska and it reache on July 3rd 2007 and it was trnasferred to Texas. I am not sure what's there in my profile, I just entered the dates when it didn't let me login to the site. It did not let login even if I didn't enter an RFE date and I had to enter some date. My I-140 was approved from Texas. One more thing, when I e-Filed for EAD and AP this year, it went to Texas, though IO gave a Midwest address which falls under Nebraska, I don't know why and I was surprised and happy too as Texas was approving the applications very fast, but mine is not yet approved (Applied on 29th June).

It is already 6:15 PM and I have to go home, if I don't answer any more don't think I am hiding. I have a life to live and don't be so negative buddies. Every body will ge their Greencard and it is just time.

I have been living in US nearly for 10 years all the time in B1, L1 and H1 visas.

People might start asking, how come you have a 2006 priority date? One employer had applied in 2004 and was in PBEC and did not get approved untill 2007 July, meanwhile I had applied another in EB2 through another employer and got Labor approved in Septmeber 2006 (less than a month) and I-140 approved (Premium) in November. After that I got three years H1 through new employer and moved to this company on 11th June 2007 Luckily everything was made current on July 13th and mailed my I-485 application on July 2nd (Just before they officially announced that visas were unavailable) and it reached on July 3rd. Again don't ask me how could I apply in EB2, when I did not do Masters in US. I have Masters from India and also had Five years of experience even before 2004, by then I was in US for more than 5 years. Also, when my employer applied Labor in 2004, I was just Five days away from my 5th year ending on L1/H1.

One more thing I bought a home in 2005 when my labor was pending some where, may be in Local Labor Department or PBEC or somewhere inbetween, and have been living happily. I am also worried about the GC but not paranoid about it.

Many guys here worry too much, just relax and live a peaqceful life. Jus think this, we are highly educated and would defintely be able to make a living anywhere in the world, not just US. Don't worry tooo much and think others have no work and want to fool you guys.

    Just my 2 cents......

this got to be the best practical solution I have seen on IV (with some modification?), approaching hillary clinton by explaining the situation is the best bet, its simple and involves an administrative fix but they anyway have to revisit the application during visa allocation,

what if a person's 485 is approved like 4 years back and he had some run-ins with law after that or something that might jeopardize his chances of 485 if it is evaluated at the time of visa allocation? this might be a 1 in 100 case but its a national security issue, solution can be as one of the members said pay an upfront fee for pre-evaluation and then when visa number is available they don't re-evaulate parts of application that don't change like birth certificate etc.,. and just look at w2s, paystubs, criminal records etc.,. in that case if it is just a pre-evaluation I am not sure how it would be of great help unless the package comes with EAD and AP,

    Fatjoe,
Thanks for your response. Wow that's quite a grill. How many days of notice did u get prior to the interview? Did you get any RFE previous to this interview.

Did you ask her any questions? Like if the case stands preadjudicated or not or if they will need more info in future?

Going by the questions, it seems she asked all that she can ask for.

    Best,

    SoP

You're welcome. I came to know from the forums that you would know well in advance (i.e) a month before the interview; I got the interview letter too a month a head. No, I did not get RFE before the interview. The interview was for my spouse, and the DAO said that my spouse might have to go for the second FP, and spouse(alone) did receive the second FP notice a few days after the interview.

Wooo... wah ...wah.. wah .. great Sherman... Is this what you mean ??

You dont care about Jobs being internationally outsourced but you do care about a guy sitting next to you and delivering better output than you... That means you fear competition OR you dont like a guy sitting next to you because he is a Macaca... ??
What ever option you choose it defeats America !! And still want to call yourself patriotic American ? America is the land of best and brightest - its the competition and drive which keeps a free,Capitalist society alive...

By the way you still didn't provide me the source how 75% folks are having under-grad degree and what % of that is in S/T/Engg/Math ....

Dont hesitate to respond - we all know the answer. Just want to hear from you.

Jobs in America is for Americans. If at all it gets outsourced to your country then it is yours. But as long as that job is in my country, I will defend it and not let some Strive or Skill act take it away from me.

I like your idea. And I do support it in spite I not being in similar situation.. However with a little bit experienece I have with similar work flow improvement projects I would like to point out that the impact on labour/cost has to be thought through. My understanding is the agency has not been using Visa numbers because they are heavily loaded. Now if you ask them to do this pre-adjudicataion for all cases that will impose a sever load on them. I may be completely wrong here - it could be another department, another agency so this may not be an issue at all.. but if possible think through this as we submit a proposal.. If needed (now gals and guys don't beat me up!) we could even pay them (So they could hire people) to get this pre-adjudication done?

Comments, retorts welcome.. no abuses pls we are all learning here!

First, deecha, and VZLAN you are brave men..hope you get through. When the immigration system is so arcane, you cannot blame yourselves
    ===============

next, I am in a similar 'somewhat out of status' position myself. i am filing for i-140/i485

I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.

For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.

Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007

I am filing a self-sponsored I140. So, my question is:

    1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?

    2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)

    3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.
    -=====-=-=-====-

    Please send me your perspectives.

vijay226: The following is just my opinion and it is in no way a personal attack. Please come up with similar ideas like the one you just posted below. Useful or not, all ideas count as long as it is pointed towards solving the issue in a constructive manner.

Reply to your message: We should not propose a fee for this kind of administrative change. There are few reasons for that. 1) This is just a workflow change and an internal procedural change for the USCIS. 2) There is no need for any additional incentive for the government as this is in effect not taking anything extra from the US soil in terms of opportunity etc. 3) Any addition of fee requires administration to get it approved through the Office of Management and Budget (OMB) and it will make this a legislative affair. That means the whole assumption of getting it through admin fix becomes invalid. 4) In any case, if administration wants to make some extra money from us, they will come up with that proposal.

Once again thanks for your great point and contribution. Please continue to do so.

i think we are also need to provide some incentive to the government also for doing this, say some nominal fees around 600$ and any one contribute more than that will be tax free which goes into financial bailout package. At the end everyone wins and everyone is happy

I had the first-hand opportunity to meet and see IV core members working for our cause. Really, it gives you the chill that thinking its the same GC everyone on this forum wants but the dedication with which they are approaching is amazing. There is no point talking about what we "could have done" after the congress session is over and god forbid, our bill doesn't pass through. 2008 is all about elections and the citizens, not too much of immigration will come to forefront, so please think.....

    Contributors> thanks for the contribution...

Sideline onlookers> Till yesterday we had about 40.08% contribution and as of noon today we are only at 43.97%, contribution of 3.89% which amounts to around $2400 :) I bet we can do so much better after all we are so called "high skilled" immigrants....

please step up and let's not make it a beg fest..here..thanks !

T I am not a core member, but I trust these guys, they have been working hard putting in their own hard-earned money for travelling, and carrying out IV work. At this point, IV really needs two things, more members and more FUNDS . IV needs you to contribute, even if it is $20

As some folks have posted on another thread, the USCIS is finally getting around to consolidating all their applications in a single database.

Maybe our letters and posters didn't fall on deaf ears after all! ;)

I had this question - how the 50k would be used? If you could post in greater detail perhaps more members would be enlightened to contribute

The only way to enlighten yourself and others is to get yourself and your friends involved and participating towards the effort. You will automatically see the sacrifices made by others who are not thinking about "I" all the time.

No sensible member would expect detailed spending reports to be published on a public forum. I hope you weren't expecting that?
