Advocacy day is going well. There are about 300 meetings being planed between today and tomorrow. Its very hectic in the situation room.

I am not arguing about who is ahead in the line to get the non-existent cake - please read my post once again and point it out to me where I said anything in such regard..
Frustration comes from the point that all the discussions take tone that all IV efforts are to help EB2 category alone. It is becoming frustrating for EB3s to keep reading posts and participating in actions when everyone keeps portraying IV effort as EB2 only effort.

I renewed my passport from NY consulate last month, but on the last page, my mother's name is spelled as "LILABEN" instead of "LILABAI". I plan to visit Canada on Sep 1st (going on cruise :)). Gurus, I need your opinion on:
- How important is it to correct this, could this mis-spelling be a problem going forward?
- Can i get this error corrected after i come back from Canada meaning after the PP has recieved entry/exit stamps?
- Is there enough time to get the job done by Sep 1st?
I am just afraid to send it again as our brilliant and efficient consultate people can mess up something more important.

This is probably not endorsed by IV. But the idea is to support one of the efforts endorsed by IV!

My opinion is that you should be fine. Just make sure that you've nailed everything down correctly on your G-325A.

Actually we were called for interview at the local uscis, : My RD was Aug-17-2007 and the ND is Oct-15-2007. The DAO - District Adjudication Offcier gave me a heart attack saying that we are not eligible for GC as the cut-off date was 17-Aug and we were out of the window. Then I politely explained her, and then she looked at the RD and said that we would be fine. Also I called USCIS last week, and told that I filed on Aug, one rep said that they go by ND, I called again and the other rep said that "by ND". Not sure, may be uscis itself is not sure.
Anyhow, is it advisable to take an infopass now (i.e) before september . Wouldn't it be better to visit uscis office in september, so that we could strongly say that "We are current, and could something be done about our case".
I'm afraid that, if we go to uscis now saying that "We will be current in Sep", the uscis people might ask us come back again in Sep. And remember, we cannot have two consecutive infopass within 45 day. So what do you suggest?

Great discussions!! we are all going in different directions... How many Labor petitions few handful? There might be ppl who are stuck legitimately and ppl who did it , it was legal. Rather we should concentrate on Retrogression of VISA numbers. Then what after July 07 , think also about 140's there were pending there are a handful with earlier priority dates. Also many times USCIS issued GC's for ppl with earlier PD's should they return their GC back ? And potato eater has mentioned its not point to argument. I dont think there are those who are blocking the system. It is sheer number of VISA's that are driving nuts. There were also proposals that VISA numbers be applied only to principal applicants. Actions like these will have impact on final numbers.
And above all this idea is not new , It was even discussed by many members (in ~2006) when Substitution was abolished. But we are already here. We will campaign like Rajiv Khanna had said and then what discuss new proposal ? I feel its not that easy to do a change for existing ones in pipeline and USCIS has completely abolished this idea altogether.
Main action agenda: Legislation to get back unused numbers. I dont want IV to waste energy or resources anything beyond this and we shouldnt keep on discussions of new proposals. Our only point of discussion should be How to get legislative fix done.
Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.
The idea inherently appeals to those who believe in fair play. How do we take this forward.

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

I had the first-hand opportunity to meet and see IV core members working for our cause. Really, it gives you the chill that thinking its the same GC everyone on this forum wants but the dedication with which they are approaching is amazing. There is no point talking about what we "could have done" after the congress session is over and god forbid, our bill doesn't pass through. 2008 is all about elections and the citizens, not too much of immigration will come to forefront, so please think.....

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.
If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.
