    I know it has been discussed a couple of times but more I read about the keeping H1 status/Using EAD &AP the more confused I get. The problem stems from the fact that we want to use the goodies offered by AOS (EAD and AP) but concerned what happens to H1 status. Don't want to get H1 stamping but want to use H1 status.

    I talked to my lawyer and she prefers that I get H1 stamping when I go abroad and keep H1 as long as possible.

    We have been longing for a while to apply for AOS so that it frees us from H1B shackles and gives us freedom to work. But now that most of us got the EAD, most people don't want to use it (except perhaps the dependents who can now work)

    I want to play the devil's advocate for a min and say why not dump H1 and go with EAD/AP route.

    One of the advantages people cite with maintaining H1 status is that if some thing goes wrong with I485 , you can still stay here as long as H1 is valid. Another advantage is you don't need to renew EAD/AP every year (Cost) because H1 is given for 3 years (If retrogressed or have H1 time left).

    1) But if my I140 is approved and I am working with a good company and the GC is applied in good faith and have good lawyers working on it, what are the chances of rejection ?

    2) What is the appetite to start the GC all over by staying on H1 in case this GC is denied after 4-5 years(Likely for most). Ability to challenge the denial of course is different story.

    3) I believe most people who got EAD/AP now will continue to extend them just in case (to be safe). So the cost benefit is out of the window. And if the company pays for all the expenses for EAD/AP renewals should I care to keep the H1 status from the cost point of view.

    4) If I am willing to use AC21 and change the employer, I believe using EAD gives me more bargaining power than using the H1 because there are more options (Some companied don't do H1) and there is less work for the company (No need to file for H1 transfer)

    5) On other hand if I dump H1 status , I can work part time using EAD or start my own business etc.

    I see that it is a unanimous opinion that keeping the H1 is a good idea (Including my lawyer suggestion).

    I intention here is not to make a statement one way or the other. As I mentioned earlier, I wanted to play devils advocate and challenge some of the perceived benefits of keeping H1 and provoke some responses so that I know I am NOT missing the benefits of H1 that other people see.

    I can understand your feelings.
    As of now, the only solution is to support IV to push for getting wasted numbers back and removing per country quota.

    Had it been the year like 1999 with all the efforts from IV, I am defintely sure the CIR reforms would have passed by now.

    Issue here is the economy, recession looming large on our face, unemployment level rising, and no one knows whats going to happen in the next two-three years becuase of credit crisis and oil price going above the roof. If this continues for another year, we will be in deep s***.
    Thats why no will dare to increase the workforce by issuing more grren cards. Atleast we should feel happy that they havent stopped issuing the cards.
    I know its painful to be waiting for years to get a GC. But you do not know how green that card will stay if the current financial crisis continues for 2-3 years.
    Fact is, this country is going thru a difficult period of uncertainty. Because of election year rhetoric, no one is going to accept it. But clearly, its not in their interest to get more workforce into this country. They know we have been waiting, and will continue to wait. Look at 2002/2003/2004, when they issued only 20K visas for the entire year. So just hope that things will get bright for this country soon else, we are in for an another hell ride.

    H1-B has the following advantages under certain conditions.

    1) If you are not yet married, you dump H1 and you are dumping the ability to bring your future wife to US immediately after marriage.

    2) Some states give driving licenses that is valid until the EAD expiry or H1-B I-94 expiry. With H1-B, your hassle of DL renewal is reduced to one third of EAD based.

    Its preposterous that USCIS does not allow LEGAL prospective permanent immigrants using EAD to bring their spouses!!

    ICICI Bank has started a 'Express Pay' service in which your monety gets transferred in 1-2 day but they charge 5 $ for that.
    I think you might have selected that option while transferring. Thats the first option ...

    My experience is even their 'Express Pay' service is a rip off unless you have experienced otherwise first hand !

    Hi Gurus,

    I need an advice from you.

    The situation:
    -- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)

    -- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.

    So what are my options now?

    1. Check with attorney and start defending..?
    2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
    3. What about my GC?

    Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

    Are you both physicians ? (the J-1's)

    Looking at your RD reminds me of a friend of mine who has a I-485 RD of Dec 2004, but he is in EB3. Unfortunately his NameCheck was not clear even in the July 2007 fiasco, the reason he is still not green !

    He and his wife recently sold their house and everything else and left their jobs and moved back to India! Enjoying themselves there while their I-485 application papers turn yellow !

    You paid 68K for legal and immigration fees... that is steeep man ! I wonder how...

    Can anyone provide some useful insight based on personal experienceas to how valuable is Part Time MBA for oppurtunities in India?

    I am IT professional with lot of experience and currently pursuing Part time MBA from a business school which is ranked in top 25 and not in top 10.

    The way I see it that it will take me around 4 years to complete it and I have to invest atleast $30,000 even if I get employer to pay a part of it.

    In the end if it fetches me a top notch management position it will be well worth it. However I see limited chances of getting into management positions in US just based on MBA degree however I am not sure about India.

    Any thoughts?

    A lot was said above but some basic things still need clarification.

    I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
    I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
    I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.

    These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege...

    No I want the RIGHT to get my GC as soon as I land here on a H1B. They should give me the GC at the airport itself. I'm not waiting one day even. ;)

    There is a difference between H1B Visa/AP and I797/EAD.
    The first one is a travel document. That is all it is good for.
    The second one is for employability proof. That is all this one is good for.

    Each one has some restrictions. As long as you are not violating any of the provisions under which you were issued a visa/AP/I797/EAD, they will be good.

    So... if you are working on a H1 (I797), going out of the country and returning by using AP will not make you lose your H1 as long as you continue to work full time for the sponsoring company.

    As far as the company is concerned, your work eligibility status is based on what you provide to them when you fill out the I9 form.
