.... Our 5 PM meeting was with a Congressman himself and had a Core team member, myself and another member who was later offered an unpaid Internship by a lobbying firm. Just when we were wondering why the position would be unpaid we were told that the reason for being unpaid was because the green card process for the member accepting the position would be reset since it would not fall under same or similar category which made all of us crack up.
Was this intern an IV member or was this intern a member of the staff - and is the lobby firm that hired him working on fixing immigration issues?
Our closing meeting went on until 11 after which each one of us took our Action items and next steps to take back to our districts. Everyone we met over the past couple of days told us to keep up the work we have been doing for the past few years. Good work and great follow through always leads to good results.

Let me guess, you have been brain washed by some jerk who claims that he is GOD. So you see things around you through the prizm of that jerk, and you think that the purpose of creating a good idea is to shoot it down.
Allow me to share some common sense, which is always tough. Every idea has its time and place. Every good idea also has its time and place. Out of time and out of place idea is as good as hurting yourself. So while you sit in your rabbit hole listening to your GOD, wanting to work on the removal of per-country limits, just open your eyes and see that the world around you is much more beautiful if you don't see it with the prizm of some jerk. Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??�Please respond.

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.
If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.

Here is the dilemma.... The Idea is great...It can change our lives But if we sit on the idea for long it will rot So DO WE TAKE ACTION or LET US WAIT FOR CORE TO COME UP WITH SOLUTION. I would suggest we form a small committee or group of people who can brainstorm and come up with possible course of actions and then present the idea to core.

My american employer rejected to file PERM after ads are posted. They were supposed to befiling in EB3 and they said they found candidates so they are not going to file green card...I am totally depressed..This is the true picture in almost all american companies. BEWARE of green card.

Yes it was stopped in 2007. But it still has its shadow. Back in India Did you leave in area where there was shortage of water? All I said is do not call them as jealous. They have valid grievances. If they want they can fight.

With my limited understanding, what I realized in last 2 years is this: VISA RECAPTURE and RETROGRESSION aka discrimination based on country of birth are the biggest obstacles for those born in countries like India, china, Philippines and Mexico. (Do you want to say that it is okay to be descriminated for being born in one of those countries?) So it does make sense to address these 2 issues. If I have limited energy (read money & support for lobbying, campaign etc), I would spend it towards where it can benefit me most.

For name change in US, you must go to the local county court and get a name change court order. That doc would contain the new name, and should be enough for updating name on any US documents such as SS, DMV, etc.

I would like to start this thread for the benefit of people who do not have a straightforward immigration history. In a nutshell, I hope in the future this thread will serve to provide information and advice on
Out of Status issues - Inconsistency with what's stamped in the passport and what you're actually doing
Unlawful Stay - Stay beyond the date in the I-94 card
The main focus will be on what these things can do to your i) AOS/CP filings ;and/or ii) future non-immigrant visas.
I came to this country because of a twist of fate and had zero knowledge of the immigration laws here. Through the school of hard knocks, I have gained considerable knowledge about this convoluted process that affects us all and hopefully what I learnt will be of use to other people in the same boat.
A special mention goes out to "unitednations" for his skill and knowledge about various issues. Thanks buddy, you're a huge asset to all of us.

A law suit may be our last resort, however I am not convinced that the time to use the option has come. However, its not wise to overlook an option. I would say lets start compiling a list of facts which potentially can be used to file a lawsuite. Please be innovative and think hard what causes you to file a lwsuit. Lets evaluate all such stances, and get them verified by an attorney.

ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level.
