    No I wouldn't. Get it from the your child's pediatrician since they know the case history and will be able to word it correctly. Remember that the letter from the pediatrician is the basis which the certified civil curgeon for USCIS will use to apply for a waiver if he/she thinks it is necessary.

    I don't know what this petition is going to do. Atleast it will convey to CNN top brass that there are people out there who won't tolerate such lies. Maybe it won't do anything now but we must continue our efforts and oppose such false propagation of information whenever we can.

    I have had v.bad experience with them ..don't open a account there ..they will harass you like anything to send this documents and that ..for me they did the same and kept my money for 9 months without paying any interest. I will post the email that I had recd from them . they even misplaced the draft which had my principal

    I took visitors health insurance from ICICI Lombard.
    There was some typo in the date of birth ( my mistake actually)..so I wanted to correct it..The callcenter ppl told me that once policy is issued you cannot make any changes to it..they advised me to cancel the policy online and buy another one..they will return the money for cancelled one.

    So I cancelled the policy and took another one.
    They sent the cheque to my parents house after couple of weeks for the cancelled policy and they deposited it to ICICI Bank account.

    Now the fun starts..the money never came into my account.

    For the next 8 months, I was BBQ'd, did a sheek-kebab of myself without any use.

    Finally, I got every email ID that ends with @icicibank.com and whereever there is @icicixxx.com and sent out an email blasting everyone..then also sent an email to icici bank manager from my online service manager.

    Finally I got a response saying they deposited the amount already 8 months ago..I was so pissed off..I took a screen shot (.bmp) of my account for that period asking them why cant I see the transaction here..

    then after a week, they emailed me saying, the amount was deposited to wrong account..means someone elses account..LOL..

    :D:D:D:D

    I havent seen such a Luchcha bank..:p

    usually..the banks give the rate the day the money was deposited in the indian bank..not the day you initieted the transfer..
    make sure u got tht rate..and how much do they charge for transfer..
    i am sure they have a customer service where you can ask the break up of charges applied to you..without CS, they wont be in this business..tlk to CS,
    they wont be happy to lose a customer.

    Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
    however after coming here , Paid for my own ticket and landed here on start of january 2011.

    Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.

    I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.

    I need to clarify a few things before i nail these blood suckers

    1. How long before i board my flight back home , should i send the documents to DOL

    2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
    or copy to send to DOL

    3. What other documents should i send alongwith

    4. Do you think my case will get weaker if iam not here ? As i am flying back to my home country.

    5. I dont want these suckers to go scott free, so how to build my case here , can i ask the DOL to recover my wages for 4 months i wasnt getting paid.


    I do not care if i get any wages or not from them , but i really wanna see the locks on the gates of this company. They shouldn't take H1B and its applicant for scapegoats.

    Any advices are welcome to help me bring these guys to justice.


    It seems like you are at fault here...why did you come here without your employer calling you. There is no strong case...what wages you are talking about when you were not reported to work.

    The point behind the lawsuit example was that just talking frivolously about lawsuits without understanding background and facts - is completely meaningless. This has been proven in the past.

    It was about why more visas were given to EB-I and less to EB-C. Nothing to do with present debate

    Thanks guys for the moral support and quick responses.

    More details are as follows:

    1. This accident occurred in 18 months back in CA
    2. We were going on high way and suddenly the car infront of me came to a sudden halt and as I didn't had any reaction time, even though I applied brakes I went and rammed into the van in front of me, which in turn hit the car infront (like a ripple effect) and totally 8 cars were involved in that collision.
    3. So at first we thought it is entirely my fault as I was coming at 50s and I rear ended the care which inturn created this ripple effect.
    4. But the actual scenario is, the van infront of me came to halt, as it rear ended the car infront of it and due to which the other car hit the one infront.

    So already one accident happened and I caused one more and as mine was a 11 seater and coming at 50s the impact was high and involved in 8 cars.
    All this happened within in mins or secs, I would say

    Myself car1 car2 car3 car4 car5 car6 car7

    In the above pictorial representation,
    a) car 1 hit car2 which in turn hit car3 (1st impact)
    b) Myself hit car1 again which ripple effected all the way upto car7 (2nd one)

    I was the only person injured and and had to be hospitalized with bi-lateral hip fractures and right knee fractures and was out of work for 4 months.Luickly my insurance covered most of the amount thats been charged(around 300K)

    Finally I recovered to a great extent and out of blue gets a lawsuit from the owner of car3 against myself, Car1 and car2.

    BTW, insurance determined that my fault is 80% as I caused the greater collision and they paid the property damages for all the cars involved.

    As per the lawsuit, seems car3 drivers spouse had herniated disc due to this accident and are expecting $200,000 for future treatment

    So they are claiming the following:
    3 milliion for : other damages(emotional etc.....) --> This is BS. You can file a counter. They are already quoting 200k for future treatment and other amt for lost wages.
    200,0000 for: future treatment
    50,000 for: lost wages

    Thats is what the story of my life :(

    Hope this gives u more details to provide me with more suggestions.

Its just a lawyer thingy to throw some mud and see if it sticks. I do not think that 200k is warranted for the treatment of a herniated disc but your insurance will take care of it so no worries.

    As suggested by all the folks here, this is a civil case and wil have no bearing on your GC. However if you don't respond you will be held liable so get a good attorney and respond to those charges. If you run away to India most certainly it will become a criminal case and you will most probably end up never be able to return here or since this involves injury to an american citizen the embassy/consulate may pursue you further even when you return back to india.

    1. If you decide to contest it, try to see if your attorney can invoke any procedure to get previous medical condition of the other party. This is to verif y if the injury/condition they are seeking damages for are a result of this accident or they had a history.

    2. Try to get details about their occupation and see if there are any occupational hazards that can cause this condition due to it. Although it can be circumstantial its worth a try.

    I know patient/doctor relation is privileged but if the law enforcement is requesting medical condition of a patient then there might be a provision to get that info. California however is totally different ball game..

    Here is a link from the injured person's attorney's point of view.. The key to winning a case is to find the weak points in the oppositions case and drive hard on it. This is not to say the other person was not injured or anything but the blood sucking claim for 3 MILL is what pisses me off.. believe me I was a person who was injured in an accident for no fault of mine and I am still fighting the case for lost wages and medical expenses only for 13 years now. Its a different matter that it is not in USA. I won the case in lower court but a counter was filed in higher court by the insurance company and its still going on.

    Life goes on despite that. Have faith and hope and things will be better as time passes. Worst case you can file bankruptcy and throw up your hands.

    On a personal level, it might be helpful to you, however there are others here who want to --start their own company, change employers, go back to school and over and above all be able breathe without feeling suffocated by the system, and reap benefits of the multiple contributions they have made, for, so many years, to the american society.

    Hello everyone,

    I was just thinking about this the past couple of months and maybe we dont even need to ask for Green cards. MAYBE our approach should be "Let the H4s work". Once husband and wife can both work, the green card can take its time. Right now the Biggest problem with most people is that "my spouse cannot work!". Maybe if we lobby for h4s to be eligible to work that may solve the problem.

    Now before this suggestion creates a HUGE "Dhoom", this is JUST a suggestion. The current political climate does not look like it is going to be easy in any way to put any provisions for Green card increases. Besides if the logic is "Let temporary workers be temporary", this approach fits in with that logic, coz we are not asking for GCs (permanent residency), just more temporary EADs.

    With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV). The more obvious things that can be found for example in USCIS handbook (http://www.uscis.gov/files/nativedocuments/M-618.pdf) are not included here. Below is a snapshot of what I have gleaned from Internet so far, and please add your own input(s):

    LIST of DO's :

    1. Carry the original PR card on your person at all times (e.g. in your wallet), keep photocopies in different places, and also store A# on your computers. Note: This is a contentious issue (do a google on "carry green card" and see for yourself), despite being required by law (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD). Some people are naturally worried about losing wallet and the eventual hassle of replacing the lost card (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=b3f7ab0a43b5d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD), whereas others, including me, prefer to follow the law, in case I am suddenly asked to produce evidence of my legal status (e.g. in some border states, or unforeseen events, such as being involved in an out-of-state car accident where showing my DL might just not be enough). Failure to comply may result in, at best a fine, and at worst detention for breaking a law. (See comments by InTheMoment below for additional perspectives.)

    2. Retain all original copies of USCIS documents related to your legal status during the entire period of stay in USA, and shred all photocopies (except when you have a photocopy but not its original).

    3. Retain all employment-related documents, particularly original copies of appointment letters.

    4. Retain copies of all tax return forms from the year of your first entry, or (at least) previous 10 years (you can request IRS (http://www.irs.gov/pub/irs-pdf/f4506.pdf), or your professional tax preparer, for any missing copy).

    5. Maintain a detailed log of USA exit/entry, including dates, POE and countries traveled, beginning with the day of first entry.

    6. Maintain a detailed list of all legal troubles, including minor traffic infractions such as speeding violations (ignore parking violations, because they do not constitute legal "detention"), going as far back as possible. Keep copies of all relevant court papers, traffic tickets, proof of any payment (e.g. scanned copies of personal checks used, credit card statements), and so on.

    7. Update your social security card (http://www.ssa.gov/online/ss-5.html) to remove any restrictive clause about work authorization printed on it. Note: AFAIK, the procedure changes nothing as far as your privileges go, and some of you may not even have such a clause on your SS card (I don't have it either).

    8. Return your I-94 cards to POE on your next trip outside USA, to "close the open files" on your past travels (I do not know what it means though). Note: AFAIK, this is also not required, and besides, you should have the chance to do this while applying for citizenship.

    9. Renew DL to get rid of the annoying "Temporary" word (in case you are in one of those states that do this).

    10. Update your status with your employer by filing new I-9 form (thanks to InTheMoment for this point).

    11. Continue to inform USCIS (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c1a94154d7b3d010VgnVCM10000048f3d6a1RCR D) about change of address within 10 days of moving, as before (thanks to seahawks for this point).

    12. Keep a list of current and past residential addresses, including dates of stay. Retain all leases/ownership documents.

    13. Remember the basics: Initiate your GC/passport renewal process at least 6 months before expiry/Intl travel (Thanks to pappu for this point.)

    14. And yes, move the family first commitment at the top of your must-do list, now that you have less worry about re-entry, and make that long-delayed trip home to see your old folks one more time. (I am visiting my 83-yr old Dad, who still has more hair than I do, and less gray too, in June.)

    LIST of DONOT's :

    1. Do not sign up for voter registration card. In particular, never vote in national/state/local elections that are open only to citizens, because this is also a law (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD). Even an accidental mistake (e.g. voting out of ignorance) is a serious offense, which would not only derail your future citizenship plan, but may even result in deportation.

    2. Do not develop a pattern of frequent and/or long absences from USA, unless you have taken prior permission for valid reasons (e.g., studying abroad, medical emergencies etc). Otherwise you may face trouble at POE on your next re-entry attempt, because DHS has become stricter in recent times about possible misuse of PR status, and POE folks are now trained to spot such patterns.

    3. Do not switch job soon after getting GC. This is one of the most discussed, but least understood, issues because no one seems to agree on "how soon is soon". The rule of thumb appears to be "6 months", and a safer bet is "1 year" (here is a thread (http://forums.immigration.com/showthread.php?t=154533) on another forum). This again relates to USCIS being increasingly sensitive to possible misuse of PR status, and this question will come up during your citizenship application process. (But, as InTheMoment points out below, the issue becomes moot if you invoke AC21.)

    4. Those of us who self-sponsored our GC via NIW or EB1A route are not bound by such employer-employee commitment, but you should continue working in "similar areas of expertise" that you claimed in your NIW/EB1A petition, and preferably on a longer time scale.

    gctest is a perfect jackass, think he is also a complete fraud.

    If you look at his posts, initially he said despite holding a doctorate and being around since 1996, he is EB2. So far so good.

    Then he says his dependents got approved on his EB2, while his case is rotting (????:D)

    The story changes dramatically after you point out if he is the real cream of the crop, he should have been easily qualified for EB1.
    The latest, breaking news is that he's from a top-notch research univ and has approved 140 in EB1 but still he's gonna fight for what's fair and against what's unfair (:D:D:D:D:D)

    Everything is made up, because the story changes all the time, when you attack him. I think the truth of the matter is he's EB2 and he's lying about EB1.

    His case never ever qualified for EB1 (publishing some academic trash doesn't qualify you for anything, see my earlier post on this thread regarding this), so he's completely sore and has lost his mind.

    We do see such threads on the forum occasionally where the employee is being cheated/asked to sign a contract/is not being paid on bench/employer is threatening etc etc... There are several instances where members have posted negative comments about consulting companies and how employees are unhappy working for them.

    Is this really true?

    I want to understand the reasons why people are not filing lawsuits against such companies yet? Why are we not reporting them to DOL and USCIS? Especially after filing I485 and expiry of 6 months, people are in a better position to file lawsuits against such employers.

    IV can help only if people are willing to be helped and ready to take action.

    If this system needs to be cleansed, then why aren't we doing it?

    Let me tell you one thing, "You've got guts, buddy", Congrats on the bold move. not many people dare to do that.

    Can he do so? - Theoratically yes, practically: highly unlikely.
    if he is a typical consulting guy with less than 50 emps, he won't do it, because such employers almost always make "adjustments" that puts them in extremely weak spot during such law suits. here are some examples:
    - a guy was laid off, his new employer sent him on a project even before filing for his H1 transfer
    -many consulting companies do not pay salary while the guy is on "bench"
    - they many times knowingly/unknowingly commit tax/accounting fraud or regulatory mistakes that can cause serius consequences

    - a friend of mine was interrviewed by a client and when the result was positive, his new would be employer called him at a McDonalds and asked him to sign the contract right there (within 30 minute of meeting), and my friend did. Now most people won't see anything wrong in here. but a lawyer told me that my friend was not given enough time to read/understand a legal document and to talk to a lawyer ideally enough time is about 2 weeks. How many small consulting companies give 2 weeks when the interview at client is clear?

    In your case, the end client is not your employer's client. Ask him to show the contract between him and the end client.

    bottom line of the story is: there are many defenses that one can play and win the case and/or even put the employer in trouble. That's why most small employers don't do much beyond sending a lawyer's notice (just to scare you enough to write down a check). A real nasty guy can even go one step further and file a law suit only to withdraw it later if you decide to fiight it.

    does soft LUD mean RFE is comming or does it mean there are just pre adjudicating. Seems like a lot of people who got a soft LUD on 485 recieved rfe. Are there any people who had a soft lud on 485 but did not recieve any rfe.
    semilarly does not having any soft LUD on 485 mean your application has not been picked up for pre adjudication.

    Not always true. They might be pre adjudicating. My 485 app had soft LUD on 02/10 and no RFE till today...
