What if we dont get any receipt notice or rejected papers till the end of this month..do we have to recreate our medical sealed envelop again? what if the doc do not have anything on the computer and can not make copies?
IN ThAT CASE WE ARE SURELY GOING TO AGAIN MISS AUGUST 17TH DEADLINE,IF NOT WILL BE STRESSED FOR NEXT ENTIRE MONTH!!!

I agree with you. Only court can decide whether this memo has incorrect interpretation of INA laws or not. Until then, this memo is valid.

Lets not assume we know all legal stuff.
Defining employer - employee relationship is different from abuse and we cannot relate these two.
I do agree that to challenge the law rightfully, one has to have credibility.
You are right that employer-employee relationship is different from abuse. However, they are related especially if employer takes legal route.
I wanted to stress thru my post that H1-B worker can not put legal fight for these memo as it has to come from employer. Only time will tell, if or when any employer takes that step.
One thing, I would like to add here is that memo are advisory in nature and they do not have force of law and apply only to USCIS officers, not to immigration judges.

I'm not working in the IT industry and this is the first time I have some idea about what the desi companies are doing in US. Yes, I think these desi companies and people who conducted those fraudulent behaviors are partly responsible for our situation here. I believe most H1B holders are decent people while some like those mentioned in the article are nuts. Bad purges good. Now all H1b holders have to pay the price.
Besides, I think those who conducted these fraudulent behavior do not deserve to be called "high-skilled workers".
H1B problems have nothing to do with retrogression.
If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?
Nothing.
Misuse and abuse of H1B program did not cause retrogression. And if the abuse ends, its not going to end retrogression. The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.
But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.

In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

My H1 which was approved back in 2006 has been re-opened today...This is the status I see on USCIS web-site

Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on April 26, 2009, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

Lets not support this bill guys. The right way to stop mis-use of H1 or L1 by companies is to make it a free market for the "employees" in visa. Let them be able to work for "any employer". Do you think the L1 guy will let him be abused, if he was allowed to change employers easily. Lets not close the doors for others, lets have an open mind to for competition and equal human treatment. Also lets see what is best for USA.
Putting more restrictions on employer is never effective. Abusing employers will always find the loopholes, and the legitimate employers will be scared away. The effective way is to get the "visa employees" more freedom.

How can I get the clause removed from my SS card?

Most of the Congressman offices are now well aware of the issues, phone campaign is not an attempt to explain them the details.
It is more of a push for them to take action by giving them a sense of how frustrated we are. Not many "normal" people would just pick up the phone and call a congressman, right?
While clicking a mouse button takes a fraction of a second, you would have to spend atleast a few minutes picking up your phone, have enough belief in your issue to have the courage to speak to a live person and convey your message.

Now I am totally confused. In private phone conferences, out of everybody on this forum, you can single me out and describe me just a fewdays back as "very knowledgeable about the politics and current affairs", but your post in the public forum above says "you bring Malice", "unjust full of most useless comments", "most fattoo", "spend their life in threat but on cyberspace they become Lion", "typical Cyber Sher".

Not sure if the social security taxes are for immigration benefits. Also, the taxes we pay are for several other services that we get in the US. Remember, even as non-citizens, we get millions of benefits such 911, clean roads, and the list will go on. Why do you think we want to immigrate?
I don't think this kind of an argument will hold any water with the press or lawmakers. There are other good arguments, and we should stick to them.

But as I have noticed, there is a lot of misinformation being spread around H1-B holders. One of those is that H1-B holders don't pay taxes. I have now read it at so many places, if I didn't know anything about H1-B visas, I would probably have believed it by now. So we really should make a point to mention that we pay taxes and social security.
