I think the Indian Passport offices give new passports with surname and first/given names. Check with the embassy.

Yes - your application will be up for lottery as mail delivered on non-working day will be considered as mail delivered on first business day after non-working day.

As some folks have posted on another thread, the USCIS is finally getting around to consolidating all their applications in a single database.
Maybe our letters and posters didn't fall on deaf ears after all! ;)
I hope so, we just have to wait to see when that will come into effect, perm took more than a couple of years to come into effect and what happened after??.. all the pending applications at that time was pushed to the BEC black hole...

I filed my I-485 last July (PD March 2005). It was transferred from the TSC to the NSC and since Dec 2007 it has been untouched too.
This is really depressing. My hopes were raised so high when the cut-off dates for EB2-I jumped forward over two years .. only to be dashed when they moved back to 2003!!
Thats when I decided to write to these incompetents.

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.

However, in the event that USCIS received more than 20,000 cases that would qualify for this exemption on April 2 and April 3, USCIS will first conduct a computer-generated radom lottery to select 20,000 filings for processing, and those filings that are not selected will be subject to the FY 2008 cap and must be considered in that random selection process as well.

I believe as per the current rules CIS routinely assigns the PD of the substitute labor as the PD of the replacement worker.

Are we not human beings? May be we are labelled "aliens" but we are certainly not from Mars! Please consider to clear the long waiting backlogs of the greencard process.

To the govt, we are the funding means...(recent H1B/L1 fees ).
To CIS -- our fees is the main source of income to run the shop..
To Illegals -- we (backlogged EB) are hostages to get their wish fulfilled if any...
To Politicians - we are the their subjects in their arguments...

You're in a tricky situation. If you leave the country now you could possibly face a 3 year ban on entry. If your H1 NOA did not contain a I-94 then you're possibly on unlawful stay. You could however file for a waiver with an explanation, but it is at the consulates discretion. I would find an Immigration lawyer and consult with him/her.

What is this waiver with an explanation? Can i do it while staying in USA? Or is it advisible for me to get out of the country before september 2007, so that even if there is a re-entry issue, it is only for 3 years?

If it were for some of the antiimmigrant folks, my friend you (sugaur) wouldn't be here a day longer. you would be "out" in a wink from this country. so dont consider yourself too supportive of anti-immigration. Even citizens are favoring resolving the ilegal immigration crisis by granting some legality to those who are here ilegally. Dont support ilegal immigration but atleast dont bash those who show support to resolving this crisis. you and me are mere temporary visitors here. please remember that your country is not this. you are here seeking prosperity and so are they. this country has a way of dealing with them and us and neither has been satisfactory so far. I know a lot of people have advised you not to go to the cops but I feel ( I have a young son ) that you should not let anyone who beat your 8 month old kid go unpunished.
I am not a lawyer but from what I have seen about this country justice is not denied . Local cops and Immigration are two separate branches of government . ( ICE enforces immigration issues )
If anyone had beaten my son then my H1b or GC or citizenship would be the last thing on my mind. My opinion - take advise from the lawyer right away.
You have made some mistakes by not checking for the nanny's references and other things but would you let her go scot free just so that she can do it to someone else's kid and maybe cause permanent harm the next time ??
